Compensation Funding Options
Scrivenger Seabrook Solicitors can offer advice on compensation funding for your injury or clinical negligence claim. The main options are:
No Win No Fee Considered
Conditional Fee Agreements (No Win, No Fee) are the best way of funding a medical negligence or personal injury claim for most people.
We may offer a No Win, No Fee arrangement whereby:
- you pay NO upfront costs
- you pay NO legal fees if you lose
You may find out more about this type of funding on our No Win – No Fee page.
If you are pursuing a medical negligence claim, you may be eligible for public funding (Legal Aid) if you are bringing the claim on behalf of a child. To be eligible your income must not exceed a prescribed level (which changes from time to time) and your assets must be below a certain limit. Scrivenger Seabrook Solicitors will advise fully when we assess your claim.
Legal Expenses Insurance
You may have existing insurance that will cover you for your compensation claim. This may be in a specific legal expenses insurance policy, however in most cases this is found as part of your motor insurance policy or home contents policy. Call us to check your policies as you have a legal entitlement to choose us to act for you despite what your policy may say which we will explain without charge.
Any such insurer cannot prevent you from instructing us despite what the policy wording may say – a recent case has determined this issue in favour of claimants’ right to choose. Don’t be bullied by the insurer. Leave it to us and we will arrange for our fees to be covered by your insurer. If you do not have appropriate cover, we have access to insurance arrangements to ensure you are protected.
Please get in touch to discuss your claim and circumstances. We will advise you how we believe you should proceed in the circumstances.
