Injury Claims
There are many different types of personal injury claims. Here are the most common ones:-
Road Traffic Accident Claims
If you can show that you have been injured as a result of the negligent driving of another driver you are likely to succeed.
Employers’ Liability claims
Your employer owes you a duty to ensure that you are reasonably safe whilst at work. There are also numerous statutory regulations which are designed to ensure safety at work. If one of those regulations has been broken you are likely to succeed with a claim. Even if a regulation does not cover precisely what you were doing at the time of the accident the position is that if you can show that the accident occurred as a result of some degree of fault on the part of the employer you are likely to succeed. There are duties, for instance, to provide training, instructions and supervision. Some tasks are so dangerous (for example working at heights or with machinery) that they have specific protective regulations attached to them. Your employer should also provide safety equipment and conduct adequate risk assessments. This would also encompass obligations to ensure that you were not exposed to the risk of contracting a disease at work.
Highways Claims
These tend to be “tripping” cases. A local authority has certain responsibilities to maintain the pavements and roads in an acceptable state of repair. If that duty has been breached a claim may well succeed provided the defect is sufficient enough. Obviously they cannot be expected to maintain pavements to “bowling green” flatness!
Product Liability Claims
Under certain legislation suppliers or manufacturers are strictly liable for injuries resulting from the consumption of or use of a product which is defective. You do not have to show negligence in such cases.
Public Liability Claims
An owner of a shop, for instance, owes a duty to ensure that visitors are reasonably safe whilst visiting the shop. If the floor is defective that would give rise to a claim as would tripping over a carelessly positioned box or other item. Public Liability claims have a very wide scope indeed. We all owe a duty to others around us not to act (or fail to act) in such a manner as would be likely to cause injury to them.
